Early Access Addendum
1. What Early Access means
The Service, currently called bitmutt, is not finished. You have been invited to use it early, for free, while we build it. In return we ask you to accept that it will change, that it will sometimes break, and that some things you would expect from a finished product are not there yet.
This Addendum adds to the Terms of Service. Where the two disagree, this Addendum wins for as long as your site runs on an Early Access licence.
Who it is for. During Early Access, the Service is offered only to site owners based in the United States. Your visitors and buyers can be anywhere your site is allowed to serve.
2. No guarantees yet
- It may be unavailable. We do not promise any level of uptime. Maintenance and fixes can happen at any time, sometimes without warning.
- It will change. Features, screens and limits can be added, changed or removed. We try to warn you before removing something you rely on, but we cannot always.
- It has bugs. Some will affect your site or your store. Tell us and we will do our best.
- Support is best effort. A small team answers. There are no guaranteed response times.
If your business, club or organization cannot live with that today, please do not depend on the Service as your only way to reach people or to sell.
3. Your data, and keeping your own copies
We take care of your data, but during Early Access we do not promise it cannot be lost. The database that holds your content, orders and settings is backed up once a day, so a serious fault could still cost up to a day of changes. Images and other files you upload are stored with a separate provider and are not part of that backup.
So please keep your own copies of anything you could not afford to lose: your original images and artwork, your product details, and your customer and order records. Your Stripe and Printful accounts keep their own records of payments and printed orders, and those stay yours whatever happens here.
4. Your licence and its end date
Your site runs under an Early Access licence. It is free. It has an end date, which is shown on the License page in your admin area.
We remind your admins by email and in the admin area 30 days, 7 days and 1 day before the end date, and your admin area shows a banner during the last 30 days. We may extend a licence, and during Early Access we expect to extend it for sites that are in active, honest use. We are not obliged to.
Who holds it. The licence is held by the person who created the site. It cannot be sold. The holder may ask to transfer it to another admin of the same site from the License page. We approve each transfer, and the new holder must accept the terms in force at the time. The holder's account cannot be removed from the site until the licence has been transferred.
5. If the licence ends
If the end date passes without an extension, your site is frozen:
- visitors see a notice that the site is temporarily unavailable, instead of your site;
- nobody can place a new order;
- buyers can still open the pages for orders they already placed;
- your legal pages stay readable, and unsubscribe links keep working;
- your admins can still sign in.
If we extend the licence, a site that was frozen only because the licence ran out opens again by itself. Nothing is deleted just because a licence ended. Closing a site for good is always a decision made by a person, never an automatic step.
6. Price
Early Access is free. We charge nothing for the Service and take no share of your sales. Stripe, Printful and any domain registrar charge you their own fees, and those are between you and them.
7. Your feedback
Telling us what works and what does not is the most useful thing you can do. Use the Support card in your admin area to ask for help, report a bug or suggest a feature, and to see where each request stands. We may use what you tell us to improve the Service without owing you anything, and we will not publish your name with it unless you agree.
8. When Early Access ends
When the Service leaves Early Access we will offer plans, and some of them will cost money. When that happens:
- we will tell your admins at least 30 days before your Early Access licence would be replaced, with the plans and their prices;
- you will not be charged anything unless you choose a paid plan;
- if you choose not to continue, your site is frozen as described in section 5, and you have at least 30 days to ask for a copy of your data before anything is deleted;
- we will do our best to move your site across as it is, but a feature you use today may be different, limited or part of a paid plan afterwards.
We may offer early sites a discount or a thank-you. This Addendum does not promise one.
9. Leaving Early Access yourself
You can leave at any time. Ask from the Support card in your admin area, or write to legal@bitmutt.com.
We may end the Early Access programme, or your part in it, with 30 days' notice. We may end it sooner for the reasons in the Terms of Service. We are building the Service in good faith, but we do not promise that it will ever leave Early Access, or that it will keep running.
10. How this fits with the Terms
Everything in the Terms of Service still applies, including the limits on our liability. Because Early Access is free and unfinished, those limits matter more here, and you accept the extra risk that comes with using something before it is ready.
We may change this Addendum in the way the Terms describe for important changes and small fixes. When your site moves to a regular plan, this Addendum stops applying to it.
